Who May Petition the Court to Change their Name?
Pursuant to the New Mexico Statutes, any New Mexico resident over the age of fourteen years may petition the district court in the district where he or she resides for a legal name change.
Is there a Publication requirement?
Yes. When filing the petition for a name change in New Mexico, the petitioner must also file proof of publication.
What is the Procedure for Children Under the Age of Fourteen?
Section 40-8-1 of the New Mexico Statutes provides the name change petition for a child under the age of fourteen must be filed by the child’s parent or guardian. There must be notice to both legal parents of the child.
