Who May Petition the Court to Change their Name?

Answer: Yes. When filing the petition for a name change in New Mexico, the petitioner must also file proof of publication.

What is the Procedure for Children Under the Age of Fourteen?

Answer: Section 40-8-1 of the New Mexico Statutes provides the name change petition for a child under the age of fourteen must be filed by the child's parent or guardian. There must be notice to both legal parents of the child.
